Terms of Service

By checking the “I Agree” box or using our services, you enter into a binding agreement with WP Website Plans, LLC (“we,” “us,” “Website Help,” or “WP Website Help“).

1. Scope of Services

We provide WordPress maintenance, security, and support services along with supporting services as outlined in your selected service or plan.

  • Best Efforts: While we use industry-leading tools for security and uptime, no service can guarantee 100% immunity from hackers or downtime. Our services are provided on a “best efforts” basis.
  • Excluded Services: Unless specifically included in your plan, our services do not include SEO rankings, lead generation, or custom theme/plugin development.

2. Client Responsibilities

To provide service, you must:

  • Maintain active Administrative access for us on your WordPress site.
  • Ensure your content is legal and does not infringe on third-party copyrights.
  • Respond to critical technical inquiries within a reasonable timeframe.

3. Limitation of Liability

To the maximum extent permitted by law, WP Website Help shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, data loss, or business interruption, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of these terms shall not exceed the total amount paid by you to us during the three (3) months prior to the event giving rise to the liability.

4. Indemnification

You agree to indemnify and hold harmless WP Website Help from any claims, damages, or expenses (including attorney fees) arising from your website’s content, your use of the services, or your violation of these terms.

5. Third-Party Tools & Licenses

As part of our Tech Stack, we may use third-party plugins or services.

  • Licenses: We provide “Agency” licenses for certain tools while you are an active subscriber. If you cancel your plan, you are responsible for purchasing your own licenses to continue receiving updates for those tools.
  • No Warranty: We are not responsible for malfunctions caused by third-party software or hosting providers.

5.1. AI-Assisted Accessibility & SEO

We may use the OpenAI API to provide automated accessibility features, specifically for generating descriptive “alt-text” for images. This helps websites remain compliant with ADA accessibility standards and improves search engine optimization.

  • Data Handling: Image data is transmitted to OpenAI for processing. We have configured our integration to ensure that no data submitted via our API is used by OpenAI to train or improve its machine learning models.
  • Retention: Data is retained by OpenAI for a maximum of 30 days for abuse and misuse monitoring purposes, after which it is deleted.
  • Sensitive Data Restriction: You are strictly prohibited from uploading images containing Protected Health Information (PHI), personally identifiable information (PII), or other sensitive data to the Media Library for AI processing. WP Website Help shall not be liable for any data breaches, HIPAA violations, or compliance failures resulting from your upload of sensitive information to these third-party AI services.
  • Privacy Policy: For more details on how OpenAI handles data, please review the OpenAI Security and Privacy policy.

6. Termination & Cancellation

  • No Lock-in: You may cancel at any time via the Client Portal.
  • Data Deletion: Upon termination, we will remove our administrative access and any managed security tools from your site. We are not responsible for maintaining backups after your account is closed.

7. Governing Law

These terms are governed by the laws of the State of South Dakota. Any disputes shall be resolved in the courts of Minnehaha County.
